Terms of Use

1. The Service

Fluentora is an English speaking practice app. It offers speaking exercises, role-play conversations, pronunciation practice, vocabulary and grammar exercises, and progress tracking. Some features depend on your device, operating system and settings — for example, AI-generated feedback requires iOS 26 or later and a device that supports Apple Intelligence.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country to agree to these Terms, to use Fluentora. If you are under the age of majority where you live, please review these Terms with a parent or guardian.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Fluentora on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not:

• copy, modify, distribute, sell or lease any part of the app or its content;
• reverse engineer or attempt to extract the app's source code, except where the law allows it;
• use the Service for any unlawful purpose, or in a way that could harm the Service or other people;
• interfere with, or attempt to manipulate, the ads shown in the app.

4. Learning content and feedback

Fluentora is designed to help you practice. It is not a substitute for a qualified teacher, and it doesn't certify your English level.

• Automated feedback can be wrong. Feedback is generated either by Apple's on-device AI model or by built-in rules. Both can miss mistakes or suggest changes that aren't necessary. The app labels which source produced each piece of feedback.
• Pronunciation scores compare words, not sounds. The score shows how closely the words speech recognition heard match the target phrase. It does not measure your accent or pronunciation of individual sounds.
• Speech recognition is provided by Apple and may mishear you, especially with background noise.

We make no promise about learning results, exam scores or job outcomes.

5. Your content

The answers you speak or type, and the progress you build, stay on your device and belong to you. We don't receive or store this content. You are responsible for keeping your device secure and, if you want to, backed up. Our Privacy Policy explains how information is handled.

6. Advertising

Fluentora is free and supported by ads provided by Google AdMob. Ads are shown at natural breaks, such as after you finish a quiz or conversation. We are not responsible for the content of ads or for any products or services they promote. Your dealings with advertisers are solely between you and them.

7. Third-party services

Fluentora relies on services provided by others, including Apple (speech recognition, speech synthesis, Apple Intelligence and notifications) and Google (advertising and consent management). Your use of these services is also subject to their own terms and privacy policies. We don't control these services and aren't responsible for their availability or behavior.

8. Intellectual property

The Fluentora app, its design, curated lessons, text, graphics and logo are owned by Axain Studios or our licensors and are protected by intellectual property laws. These Terms don't give you any rights to our trademarks. Apple and Apple Intelligence are trademarks of Apple Inc. Google and AdMob are trademarks of Google LLC.

9. Changes and availability

We may update, change or discontinue features of the Service at any time. We don't guarantee that the Service will always be available, uninterrupted or error-free.

10. Disclaimer

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Axain Studios will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or opportunities, arising from your use of or inability to use the Service. Because Fluentora is provided free of charge, our total liability for any claim relating to the Service is limited to fifty U.S. dollars (US$50). Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You can stop using Fluentora at any time by deleting the app. We may suspend or end your license if you breach these Terms. Sections 4, 8, 10, 11, 13 and 14 survive termination.

13. Apple App Store terms

If you downloaded Fluentora from the Apple App Store, you and we acknowledge that:

• These Terms are between you and Axain Studios only, not Apple. We, not Apple, are solely responsible for Fluentora and its content.
• Apple has no obligation to provide any maintenance or support for Fluentora.
• If Fluentora fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for it (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Fluentora.
• We, not Apple, are responsible for addressing any claims relating to Fluentora or your possession and use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that Fluentora or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using Fluentora.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

14. Governing law

These Terms are governed by the laws of [country / state], without regard to its conflict-of-law rules. If you are a consumer, you also keep any protections given to you by the mandatory laws of the country where you live.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the effective date above and, for significant changes, let you know in the app or on this website. If you continue to use Fluentora after the changes take effect, you accept the updated Terms.
